Have you rented a car from Avis or Budget recently? If so, you may be entitled to a partial reimbursement of certain fees and toll-related charges associated with the “e-Toll” electronic toll payment system as part of a class action settlement.
Avis and Budget are paying $45 million to their customers, and we’ll help you determine whether you are eligible for a settlement, and if so, how much you may be entitled to receive.

Avis & Budget got sued over their electronic toll payment system.
So this lawsuit is all about some fees and charges that Avis and Budget customers had to pay when they used the “e-Toll” electronic toll payment system.
The person who filed the case is saying that Avis and Budget broke the rental agreement and violated fee disclosure laws by not telling customers about these hidden fees — which unexpectedly appeared on their bills. The fees were $2.50 per day, or up to $10 a week.
Although they settled the lawsuit, Avis and Budget say that they didn’t do anything wrong and that the case against them is without merit.
The Avis & Budget settlement applies to you if you were charged e-Toll fees.
Not everybody who has rented from Avis and Budget qualifies for this settlement. To be eligible, you need to:
- Be a U.S. resident.
- Have used Avis or Budget between April 1, 2007, and Dec. 31, 2015 (or for transactions in Florida, Texas, and Colorado, between March 2, 2009, and Dec. 31, 2015).
- Have incurred e-Toll-related charges associated with the e-Toll electronic toll payment system.
- Have paid the e-Toll-related charges and not received a refund for any portion of the rental transaction directly from the rental company.
- Not have had the charges paid directly by a third party.
You could get up to $46.07 in the Avis & Budget settlement.
According to the settlement terms, for your first and second rental transactions, you’ll be entitled to an 80% reimbursement of the e-Toll-Related Charges. For your third through seventh rental transactions, you’ll be able to get a 65% reimbursement.
Here’s an overview of the average settlement amounts based on the number of rental transactions:
- For 1 rental transaction, the average settlement amount will be $9.36
- For 2 rental transactions, the average settlement amount will be $18.13
- For 3 rental transactions, the average settlement amount will be $24.89
- For 4 rental transactions, the average settlement amount will be $31.58
- For 5 rental transactions, the average settlement amount will be $38.13
- For 6 rental transactions, the average settlement amount will be $44.61
- For 7 rental transactions, the average settlement amount will be $46.07
You have until Feb. 28, 2023, to file a settlement claim.
To receive a partial reimbursement, you must submit a Claim Form by Feb. 28, 2023. You can submit your Claim Form online or by mail (but it must be postmarked by the deadline).
On Feb. 23, 2023, the court will have a hearing to decide if the settlement is approved. There’s a chance that someone could appeal this decision, but it’s uncertain if they will and how long it will take. Once everything is sorted out, the settlement payments will be given out as soon as possible.
